HIV-Positive Miami Man Granted Year’s Stay on Deportation to Venezuela

Miami Deportation Proceedings

In a rare show of compassion, U.S. Immigration and Customs Enforcement (ICE) has suspended deportation proceedings against an HIV-positive man in Miami. Ricardo Querales is a hair stylist who was granted political asylum in 2004. That immigration status was revoked after he was arrested in 2009 for felony possession of a controlled substance and misdemeanor charges associated with drug paraphernalia. With help from his Miami immigration lawyer, Querales has been granted the right to remain in the U.S. on a temporary basis to receive medical treatment that might not be available in his home country of Venezuela.

A Humanitarian Crisis

Venezuela is currently experiencing economic difficulties that could prevent patients like Querales from receiving the necessary medications to protect their health. In some cases, Venezuelan residents have even had difficulty in acquiring food and other basic necessities of life. These conditions prompted Querales’ doctor to state that deporting him back to Venezuela would be tantamount to issuing him “a death sentence.” By remaining in the U.S., Querales will be able to receive life-saving treatments that could keep him healthier for years into the future.

A Temporary Solution

While Querales has received a temporary reprieve from deportation, he must report to ICE in a year to revisit this decision. During the interim period, he will be under the supervision of ICE officials and will be allowed to work and live in the Miami area. The case highlights the importance of seeking the help of a qualified Miami immigration lawyer to address issues with visas and residency status as quickly as possible. Without this legal assistance, Querales might have been deported to Venezuela immediately, which could have caused significant damage to his health.
