ICE Issues Fake Immigration Court Dates

Immigration Lawyer in Miami

Last month, ICE told all migrants to attend the immigration court hearings held on January 31, or risk being deported. Immigrants were given Notices To Appear (NTAs) for the hearings, but immigration attorneys said the January 31 hearing date provided by ICE was false. Attorneys discovered the date was fake when they were attempting to confirm the hearing date with the courts, the night before they were alleged to take place.

Fake dates issued by ICE, cause hundreds of immigrants, who don’t have legal representation, to show up for non-existent court hearings. The Executive Office of Immigration Review informed ICE and DHS that the immigration courts would reject any NTA that had a fake date listed on it. ICE blames the recent issuing of the fake January 31 hearing date on the government shutdown.

Migrants are feeling distrustful toward the immigration system. Two-thirds of the immigrants don’t have legal representation, so they don’t know about the fake dates and will show up for the non-existent court hearings, traveling many hours to get there. When they arrive at court, nobody is there to help them. To routinely receive fake dates on the NTAs could cause the migrants not to show up for the actual court hearings because they will distrust the dates. Failure to show up to an immigration hearing can initiate immediate removal proceedings to occur, regardless of how many uninterrupted years the immigrant has lived in the U.S.
