Registration and login do not use an SMS verification code. We do not text you a one-time passcode to create or sign in to an account.

If you use Skip and do not register, we do not create an account or store your name, phone, or email on our servers.

We collect location only at the moment you press SOS, so we can include a short-lived map link in the alert. We do not track your location in the background.

3. SMS / text messaging (required for our texting program)

What we collect for SMS

We collect SMS-related data only from people who themselves agree to receive texts, or from the firm’s own monitored line:

– Mobile phone number (required to deliver messages)
– Name
– Email address (if provided)
– Consent record (what that person agreed to, and when)
– Which App user they agreed to receive SOS alerts for (if they are an SOS contact)
– Opt-out status
– Location captured at the time of an SOS press (used to build a short-lived map link in a message the contact already agreed to receive)

This information is used to send only the messages that person consented to, to notify the firm, and to keep proof of consent.

We do not send a first text to someone to ask them to opt in. A consent link or QR code is shared by the App user through their own phone or in person, not by our SMS program.

What texts we send

Twilio / program texts may include:

– SOS alerts to an emergency contact only after that contact has opted in themselves (for example, by opening a consent page the App user shared and checking an unchecked box). A typical message says that a named user pressed the Pozo Goldstein SOS, that they may be facing detention, and includes a short-lived map link.
– SOS alerts to Pozo Goldstein’s monitored firm line.

We do not send SMS verification codes for registration or login.

We do not send marketing or “legal services” texts on this SMS program. If you registered and agreed that Pozo Goldstein may contact you about legal services, that follow-up is by phone or email, not by this texting program.

Message frequency varies. SOS texts are sent only when the App user triggers SOS, and only to contacts who already opted in. Message and data rates may apply.

Mobile information will not be shared for marketing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell mobile phone numbers. We do not share SMS opt-in data or consent with third parties for their own marketing.

Who helps us send texts

We use service providers to operate the App and deliver SMS, including our SMS provider (Twilio) and our cloud/app backend (such as Firebase). They may process phone numbers, message content, and related data only to provide those services to us.

How to opt out and get help

You may opt out of SMS messages at any time by replying STOP to any message. You will receive one confirmation message and then no further SMS from this program.

You may also turn off SMS in the App settings, if that control is available, or contact us at the phone number or email below.

4. SOS contacts and location

If you add someone as an SOS contact, we store their name and number as pending. We do not text them on our SMS program until they opt in.

You share a consent link or QR code with them using your own phone, email, or in person. On that page they may check an unchecked box agreeing to receive SOS alert texts from Pozo Goldstein, LLP if you press SOS. We keep their consent record (time, number, and which user they approved).

Until they submit that form, they will not receive a Twilio SOS text. You may still choose to message them yourself from your own phone.

After they opt in, we text them only when you press SOS. They may reply STOP at any time.

Location is captured only when SOS is pressed. The map link we include is short-lived / expiring. We do not use SOS location for advertising.

5. Immigration authorities

We do not voluntarily share your App registration information, SOS contacts, or SOS location with immigration authorities.

We may disclose information if required by law or valid legal process, as described in Section 1. We do not share information with immigration authorities for marketing or for any purpose other than legal compliance or the operation of the services you requested.

Using this Website or App does not, by itself, create an attorney-client relationship.

6. Data minimization, retention, and deletion

We aim to store only what is needed to run the Website, App, SOS alerts, and (if you registered) the firm’s registrant list.

We keep SMS and account information while you remain opted in or keep an account, and for a reasonable period afterward to handle support, security, and legal record-keeping.

If you created an App account, you may delete it in the App. Deletion removes your user record, saved SOS recipients, and authentication record, subject to alerts or records we must keep for security or law.
