Gaspar-García Released to Family After Online Petition Highlights His Plight

Miami ICE Arrest

An online petition that received nearly 900 signatures resulted in the release of a Guatemalan man with Down syndrome who was arrested by officials of Immigration and Customs Enforcement (ICE) on March 28, 2018. Juan Gaspar-García was picked up as part of what ICE called a criminal raid on his employer, TentLogix. His brother was also briefly detained by ICE but was released shortly after the raid because of his status as a recipient of Deferred Action for Childhood Arrivals, better known as DACA. Gaspar-García will be allowed to stay with family members while his case is pending.

Detained at the Broward Transitional Center

Gaspar-García was held for three weeks at the Broward Transitional Center in Pompano Beach. It was only after repeated requests by his family members and immigration activists that ICE released Gaspar-García to the care of his family. With the help of a qualified Miami immigration lawyer, the family hopes to find a viable pathway for Gaspar-García to remain in the U.S. legally.

Protocols for Special Needs Detainees

According to an ICE manual, detainees with special needs or disabilities are entitled to special protections when in custody for immigration issues. Staff members at these facilities are required to offer appropriate assistance to these detainees, including reading and explaining forms, providing information on accommodation requests and ensuring that they understand that they are entitled to a Miami immigration lawyer to represent their cases in court. It is not yet clear whether these protocols were followed in the case of Gaspar-García.
