El Paso Court of Immigration Receives Administrative Judge Complaints

Mistreatment and malfeasance on the part of immigration judges could be having an impact on the decisions handed down by the court system responsible for deciding on asylum and other immigration judges. A recent report on the El Paso Service Processing Center highlights some of the more extreme examples of bias, violations of due process and other issues in the handling of cases in this court. An administrative judge complaints were filed by a number of immigration advocacy groups against the El Paso court on April 3, 2019.

Details of the Administrative Judge Complaints

While a significant portion of the complaint consisted of anecdotal evidence and sworn statements by attorneys, the statistics for the El Paso court presented a grim picture for immigrants who came before the judges in this facility. Less than four percent of those who applied for asylum through the El Paso court were approved between 2013 and 2017. This low percentage of approvals is indicative of a hostile environment for immigrants in the facility and among the judges entrusted with determining their legal status.

Derogatory Comments by Judges

Some of the comments detailed in the administrative complaint included instances of judges calling attorneys “lazy” or “dishonest.” Sexist comments about the appearance of female immigrants and insulting remarks about the mental health of some individuals in court were also reported in the complaint, which listed several judges by name and provided details of their unacceptable comments.
