Supreme Court Ruling Leads to Dismissal of Thousands of Deportation Cases

Deportation Cases

A recent ruling by the U.S. Supreme Court may provide real help for immigrants facing deportation proceedings. On June 21, 2018, the court made a ruling on Pereira v. Sessions that found that notices to appear in immigration proceedings must contain a date and time of appearance as well as a place at which to appear. This led to a wave of dismissals of deportation cases in the ten weeks following the ruling and may offer an avenue of appeal for those still awaiting a decision from the immigration courts.

Thousands of Deportation Cases Terminated

Over 9,000 deportation cases were terminated in Summer 2018 as a result of the ruling made by the Supreme Court and challenges filed by attorneys on behalf of their clients. Nearly all the dismissed cases involved notices to appear that did not contain the date and time that the defendant was to appear in immigration court. Without this information, the notices were not legally valid. The Pereira v. Sessions ruling prevented federal immigration courts from pursuing deportation proceedings and orders against individuals who received this incomplete and faulty paperwork.
