These Terms and Conditions (“Terms”) govern your use of the website https://pozogoldstein.com (the “Website”), the Pozo Goldstein mobile application (the “App”), and the Pozo Goldstein SMS / SOS Alerts text-messaging program.
By using the Website or App, creating an account, or opting in to text messages, you agree to these Terms. If you do not agree, do not use the Website, App, or SMS program.

1. Who we are

2. No attorney-client relationship from using the Website or App
Using the Website or App, filling out a form, creating an account, or receiving a text does not by itself create an attorney-client relationship.
Confidential or time-sensitive legal information should not be sent through a website form. An attorney-client relationship is formed only if the firm agrees to represent you, typically in a signed engagement.
Website and App content (including Know Your Rights cards) is general information, not legal advice for your specific situation. Laws vary by location. Consult an attorney about your own case.
3. Website use
You may use the Website for lawful purposes only. You agree not to:
– Misuse forms, intake pages, or payment pages
– Attempt to break into or disrupt the Website
– Scrape or copy the site in an abusive way
– Submit false information
We may change or stop any part of the Website at any time.
The Website may link to other sites. We are not responsible for those sites.
Online payment or consultation-fee pages, if offered, are subject to the instructions on those pages. Use of a payment form does not by itself retain the firm.
4. The App
The App provides Know Your Rights resources and an SOS tool that can text people who themselves agreed to be your SOS contacts, and can notify the firm.
You may skip registration and still use safety content. Some features (saving SOS contacts, notifying the firm as a registered user) need an account.
Registration and login do not use SMS verification codes.
You must be 18 years of age or older to create an account or use the SMS program.
You are responsible for the accuracy of the name, phone number, and email you enter, and for sharing the SOS consent link only with people you want as emergency contacts.
You may delete your account in the App. Deletion removes your account data as described in the Privacy Policy.
The App does not contact 911 or emergency services. It alerts your chosen contacts and the firm. It does not dispatch police, fire, ambulance, or any government responder.
5. SMS Messaging Terms (Pozo Goldstein SMS / SOS Alerts)
This section is the SMS program description carriers and Twilio require.
5.1 Program name and description
Pozo Goldstein, LLP SMS / SOS Alerts Program
Pozo Goldstein, LLP sends automated text messages for the App’s SOS program. Messages may include:
– SOS alerts to emergency contacts who opted in themselves, sent only when the App user they approved presses SOS, including that user’s name and a short-lived map link
– SOS notification to the firm’s monitored line
This program does not send registration or login verification codes.
This program does not send marketing or legal-services advertisements. Firm follow-up after App registration, if you agreed to be contacted about legal services, is by phone or email.
We do not text a person on this program until that person has given their own consent. Adding someone’s number in the App is not enough.
5.2 Message frequency
Message frequency varies. SOS messages are sent only when an App user triggers SOS, and only to contacts who already opted in. The firm line is notified when SOS is triggered.
5.3 Message and data rates
Message and data rates may apply. Your carrier’s rates for sending and receiving texts apply. If you have questions about your plan, contact your wireless provider.
5.4 How you opt in
SOS contacts (the people who receive the alert).
The App user picks a contact and shares a consent link or QR code using their own phone, email, or in person. We do not send that link by our SMS program. The contact opens the page and checks an unchecked box agreeing to receive SOS alert texts from Pozo Goldstein, LLP if that user presses SOS. The page states that message frequency varies, message and data rates may apply, and they can reply STOP to cancel or HELP for help. It links to this page and to our Privacy Policy. Only after they submit that form will we send them a Twilio SOS text.
A contact may also opt in by texting START to our program number after they have seen the program information (for example on the consent page or a QR code), not after an unsolicited first text from us.
App users.
Creating an account does not opt you in to SMS and does not send you a verification text. If you register and agree that Pozo Goldstein may contact you about legal services, that is consent for phone or email follow-up, not for this SMS program.
Consent to SMS is not required to receive legal services from the firm, and you may skip App registration.
5.5 Opt-out (STOP)
You can cancel the SMS service at any time. Just text STOP to the number that messaged you. After you send STOP, we will send one SMS to confirm you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, complete the SOS consent form again or text START.
5.6 Help (HELP)

5.7 Carrier liability
Wireless carriers are not liable for delayed or undelivered messages. Carriers do not guarantee that texts will be delivered.
5.8 Privacy Policy

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5.9 Age
You must be 18 or older to opt in to this SMS program.
6. SOS alerts — extra rules
Saving a number in the App only marks that person as pending. We will not send them a program SMS until they complete their own opt-in.
By pressing SOS, you ask us to text only contacts who already opted in, to notify the firm, and to include a short-lived location link.
You agree to share the consent link only with people you want as emergency contacts, and not to pretend that someone opted in if they did not.
SOS is not a substitute for calling 911 or other emergency services when you can do so safely.
We cannot guarantee that a text will send, that a recipient will read it, or that the firm will reach you. Delivery depends on signal, your device, carriers, and whether the contact has opted in.
Location links expire. Do not treat a map link as a permanent record.
7. Registration and “contact me about legal services”
If you register in the App and agree that Pozo Goldstein may contact you about legal services, the firm may use the name, phone, and email you provided to follow up by phone or email. That is not SMS opt-in and does not send a verification text.
This still does not, by itself, make you a client of the firm.
You can ask us to stop that follow-up by emailing or calling us. SOS contacts stop texts as described in Section 5.5.
8. Intellectual property
The Website, App, logos, and content are owned by Pozo Goldstein, LLP or its licensors. You may use Know Your Rights materials for your personal, non-commercial use. You may not copy the App or our branding for your own product without our written permission.
9. Disclaimer
THE WEBSITE, APP, AND SMS PROGRAM ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App or texts will be uninterrupted, error-free, or available in every location (including during detention or when there is no signal). Rights content is bundled for offline use; sending an SOS requires a network connection.
10. Limitation of liability
To the fullest extent allowed by law, Pozo Goldstein, LLP is not liable for indirect, incidental, special, or consequential damages, or for failed or delayed SMS, failed location sharing, or a recipient’s or the firm’s inability to respond.
Nothing in these Terms limits liability that cannot be limited under Florida law, including liability for our own professional legal services if we have been retained under a separate engagement.
11. Indemnity
You agree to indemnify and hold Pozo Goldstein, LLP harmless from claims arising out of your misuse of the Website or App, or your sharing someone’s number or consent link in a way they did not agree to.
12. Changes
We may update these Terms by posting a new version on this page. The “Last updated” date will change. Continued use after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts in Miami-Dade County, Florida, have exclusive jurisdiction, except where applicable law requires otherwise.
