USCIS Policy Change Will Allow Denial of More Immigration Applications

Denied Immigration Application

A new immigration policy went into effect on September 11, 2018, that could cause significant harm to the chances of immigrants seeking green cards, citizenship and other changes to their status with the United States government. U.S. Citizenship and Immigration Services (USCIS) announced updated guidance on immigration applications that provides government officials with increased authority to deny applications that contain minor mistakes or fail to provide all of the required information on the first try.

Eliminating Courtesy Warnings

Before the updated guidance was released, USCIS typically issued what the agency referred to as courtesy warnings.

  • Request for Evidence warnings let applicants know that some of the information needed to receive a positive outcome for their cases had not yet been received by USCIS.
  • Notice of Intent to Deny warnings were intended to inform applicants of discrepancies or lack of documentation required to evaluate the case fairly and quickly.

By eliminating these notifications, USCIS will be able to reject and close more applications for citizenship and visas. This could lead to increased risks of deportations and other negative actions by USCIS and Immigration and Customs Enforcement (ICE).
