On December 4, 2020, U.S. District Judge Nicholas Garaufis ruled that the Department of Homeland Security acted unlawfully when it decided to deny all Deferred Action for Childhood Arrival (DACA) applications. The move came in response to a U.S. Supreme Court decision that blocked the Trump administration’s efforts to reverse and block DACA protections for current recipients. Judge Garaufis found that Acting Homeland Security Secretary Chad Wolf lacked the legal authority to make changes to DACA because he rose to his current position unlawfully. For individuals who have been unable to make a Miami DACA application, this reversal is good news and could provide hope for those already in this country and seeking to study and work here legally.
New Administration May Bring New Hope
President-elect Joe Biden has already indicated that he plans to restore DACA within the first 100 days of his presidency. For some, however, the changes to DACA have already created hardships. Young people who have been unable to file their Miami DACA application have not been able to qualify for federal financial aid to pursue their dreams of college. Worse yet, the attempted reversal of DACA has left current students without the resources needed to continue their education. If Biden lives up to his promises, however, the delay in filing a Miami DACA application may represent only a temporary setback for these immigrants.
